Terms of Service

Core Service Features:

• Templates: Pre-designed motorsport templates (Links, RaceCard, Motorsport) with customizable blocks
• Editor: Form-based content editor with real-time preview and autosave
• Hosting: Managed hosting on Vercel global CDN with HTTPS and custom domain redirect support
• Gallery: Media storage with automatic image optimization (limits by plan: Free 20, Pro 50, Max 100)
• AI Assistant: Alice AI powered by Google Gemini for content generation via editor sparkle buttons, batch AI fill, floating chat, and full-page chat (Max plan only)
• Content Moderation: Automated safety scanning using OpenAI (text/image moderation) and Google Web Risk (URL safety)
• Authentication: Secure login via email OTP, magic links, or Google OAuth through Supabase Auth
• Database: PostgreSQL with Row-Level Security (RLS) ensuring data isolation between users

Service Availability:

We aim for 99.9% uptime but do not guarantee uninterrupted service. Maintenance windows, infrastructure updates, and unforeseen technical issues may cause temporary downtime. We will provide advance notice for scheduled maintenance when possible.

Account Creation

To use RaceXa, you must create an account with a valid email address and unique username. You can sign up using email verification (OTP), magic links, or Google OAuth. All accounts are subject to verification to prevent spam and abuse (Google reCAPTCHA v3).

Account Security & Responsibilities

• Provide accurate, current, and complete registration information (email, username)
• Maintain the security and confidentiality of your account credentials
• Notify us immediately at security@racexa.com if you suspect unauthorized access
• Accept full responsibility for all activities conducted through your account
• Do not share your account or allow others to use your login credentials
• Comply with all applicable laws and regulations when using the service

Username Policy

Your username becomes part of your public site URL (racexa.com/[username]/[template]). Usernames must be unique, appropriate, and not impersonate others or infringe trademarks. You can change your username up to 5 times per account lifetime. Username changes do not redirect old URLs.

Age Requirements

You must be at least 13 years old to create an account (or 16 in the EU/UK). Users aged 13-17 require verifiable parental or guardian consent. We may request proof of age or consent at any time.

Account Suspension & Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, host prohibited content, or pose security risks. Suspended accounts may be reviewed before reinstatement. Terminated accounts result in permanent deletion of all data after a 30-day grace period.

Permitted Uses

RaceXa is designed for motorsport and automotive professionals to create professional portfolio websites, showcase achievements, promote racing-related businesses, and engage with the motorsport community. You may publish race results, team information, sponsor details, career highlights, and contact information.

Strictly Prohibited Activities

The following activities will result in immediate account suspension or termination:

• Adult/NSFW Content: Pornography, OnlyFans-style content, escort services, or sexually explicit material
• Gambling: Online casinos, betting platforms, poker sites, or illegal gambling services
• Cryptocurrency Scams: Pump-and-dump schemes, fake ICOs, crypto gambling, or fraudulent token sales
• Illegal Content: Pirated software, stolen media, copyright infringement, counterfeit goods, or illegal drug sales
• Phishing & Malware: Fake login pages, malware distribution, virus hosting, or credential harvesting
• Hate Speech: Content promoting violence, discrimination, or harassment based on race, religion, gender, or orientation
• Impersonation: Pretending to be another person, racing driver, team, brand, or organization without authorization

Platform Abuse & Resource Restrictions

• No Reselling: Do not resell RaceXa hosting, templates, or services as your own offering or white-label solution
• No CDN Abuse: Do not use gallery storage or CDN for third-party file hosting, image compression services, or unrelated content delivery
• No API Abuse: Rate limits apply to all API endpoints. Exceeding limits may result in temporary IP blocks
• No Scraping: Automated scraping, crawling, or data harvesting of RaceXa content without permission
• No Spam: Mass account creation, automated submissions, or unsolicited promotional content

Technical & Security Restrictions

• Do not attempt to bypass authentication, RLS policies, or access controls
• Do not reverse engineer, decompile, or extract source code from our platform
• Do not inject malicious code (XSS, SQL injection, CSRF attacks) into content fields
• Do not interfere with service operation, overload servers, or conduct DDoS attacks
• Do not access other users' accounts or data without authorization

Content Moderation

We employ automated multi-layer content moderation to protect users and maintain platform integrity. Before content is saved or published, it is scanned using:

• OpenAI Moderation API - Analyzes text and images for sexual content, violence, hate speech, harassment, and self-harm
• Google Web Risk API - Checks URLs for malware, phishing, unwanted software, and social engineering threats

Flagged content may be automatically blocked or subject to manual review. We reserve the right to remove content, suspend accounts, or report illegal activity to authorities without prior notice. Repeat violations result in permanent account termination. Moderation is necessary for platform safety and does not constitute editorial review or endorsement of user content.

Your Content

You retain ownership of all content you upload to your racing websites, including text, images, videos, race results, and other materials. You grant us a license to host and display your content as part of providing our service.

Content and Moderation

You are solely responsible for the content you upload, publish, or transmit using RaceXa. We reserve the right to review, remove, or restrict access to any content that violates these Terms or our policies. Violations may result in suspension or permanent ban without notice.

We may, but are not required to, monitor or moderate content. We also may remove content in response to reports, copyright complaints, or where we believe the content poses a legal or safety risk.

License to Operate the Service

By uploading content to RaceXa, you grant RaceXa a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely as required to operate, provide, and improve the service (including distribution to visitors of your sites). This license ends when you remove your content, except to the extent that others have copied or stored it in accordance with these Terms.

Our Platform

RaceXa owns all rights to the platform, including software, designs, templates, and features. You may not copy, modify, or redistribute our platform or its components.

Content Responsibilities

• Ensure you have rights to all content you upload
• Respect copyright and trademark laws
• Obtain necessary permissions for racing photos and data
• Avoid uploading content that violates third-party rights

Subscription Plans

RaceXa offers three subscription tiers with different features and limits:

• Free Plan (£0/month): Limited single-page templates, 20 gallery images, basic features, community support
• Pro Plan (£9/month): All single-page templates, 50 gallery images, advanced SEO, email support, 30-day free trial available
• Max Plan (£19/month): All templates including multi-page, 100 gallery images, Alice AI assistant, full analytics, priority support, 30-day free trial available

Add-on: Gallery Expansion (+50 images) available for £5/month on any plan.

Free Trials

Pro and Max plans include a 30-day free trial. Your payment method will be charged automatically at the end of the trial period unless you cancel before the trial expires. You will not be charged during the trial period. One trial per user account.

Payment Processing

All payments are processed securely through Stripe. RaceXa does not store credit card numbers or payment details. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. All prices are in GBP (£) and exclude applicable taxes unless otherwise stated.

Billing & Renewal

• Subscriptions are billed monthly in advance on the same day each month
• Subscriptions auto-renew until cancelled
• Failed payments may result in service suspension after 7 days grace period
• You are responsible for updating payment information to avoid service interruption
• Price changes require 30 days advance notice via email

Cancellation & Refunds

You can cancel your subscription at any time through Settings → Billing. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period ends. No refunds are provided for partial months or unused time, except as required by law.

Refund Policy: Free trial cancellations before trial end date are not charged. Refunds for the first month of a paid subscription may be granted at our discretion within 7 days of initial charge. Contact billing@racexa.com with your request.

Downgrades & Feature Loss

Downgrading to a lower plan may result in loss of access to certain features, templates, or gallery capacity. If your gallery exceeds the new plan limit, you must delete images or purchase the Gallery Expansion add-on. Content beyond plan limits will become inaccessible but not deleted for 30 days.

Taxes

Prices exclude VAT and other applicable sales taxes unless stated otherwise. You are responsible for paying all taxes associated with your use of the service. We will collect and remit taxes where legally required.

Service Level

We strive to maintain 99.9% uptime for our hosting services. However, we do not guarantee uninterrupted service and may perform maintenance that temporarily affects availability.

Customer Support

We provide customer support through various channels including email, live chat, and documentation. Support response times vary by subscription plan.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our service with reasonable notice to users.

Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our service, you agree to our Privacy Policy.

Cookie Policy

We use cookies and similar tracking technologies to enhance your experience, analyze site usage, and provide personalized features. By using RaceXa, you consent to our use of cookies as described in our Cookie Policy.

Data Collection and Usage

We collect and process personal data necessary to provide our services, including:

• Account information (email, username, profile data)
• Website content you create and publish
• Usage data and analytics (with your consent)
• Technical information (IP address, browser, device type)
• Payment information (processed securely by third parties)

We do not sell your personal data to third parties. We only share data with service providers necessary to operate our platform (authentication, hosting, analytics).

Data Security

• We implement industry-standard security measures
• Your website data is regularly backed up
• We use encryption for data transmission and storage
• You can export your data at any time
• You can delete your account and data upon request

Your Rights

Under GDPR (EU) and CCPA (California), you have the following rights:

• Right to access your personal data

Third-Party Services

We use trusted third-party services to operate our platform. These services have their own privacy policies and may process your data according to their terms. Our third-party providers include:

• Supabase - Authentication and database
• Vercel - Hosting and analytics
• Stripe - Payment processing
• Google - Analytics (GA4), reCAPTCHA, Gemini AI, Web Risk API
• OpenAI - Content moderation
• Resend - Email delivery

Service Limitations

• We provide the service "as is" without warranties
• We do not guarantee specific results or outcomes
• Our liability is limited to the amount you paid for the service
• Some jurisdictions may not allow limitation of liability

Account Termination

You may terminate your account at any time. We may also terminate or suspend your account for violations of these terms or other legitimate business reasons.

Effect of Termination

• Your racing websites will be taken offline
• You lose access to all platform features
• Your data may be deleted after a grace period
• Outstanding payments remain due
• You can export your data before termination
• We may suspend or terminate accounts at any time for violations of these Terms or at our discretion. Some suspensions or terminations may occur immediately where we believe there is a risk to users or the platform.

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. For international users, local consumer protection laws may also apply.

Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve the issue informally by contacting legal@racexa.com.

EU/UK Consumer Rights

If you are a consumer in the EU or UK, you may also have the right to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

Notification of Changes

• Material Changes: We will notify you by email at least 30 days before changes take effect
• Minor Updates: Non-material changes (clarifications, formatting) will be posted without advance notice
• Acceptance: Continued use after changes take effect constitutes acceptance of updated Terms
• Rejection: If you do not agree to updated Terms, you may cancel your account before they take effect
